This Privacy Policy describes how Special Minds Pte Ltd ("Special Minds", "we",
"us", or "our") collects, uses, discloses, retains, and protects your personal data
when you use our website www.specialminds.com.sg (the "Website") and our
services (the "Service").
We are committed to protecting your privacy and handling personal data responsibly
and in accordance with applicable Singapore laws and regulations, including the
Personal Data Protection Act 2012 ("PDPA").
By using the Website or Service, you acknowledge the collection, use, disclosure,
and retention of your personal data for the purposes described in this Privacy Policy
and as otherwise permitted or required by applicable law. Where consent is required
under applicable law, Special Minds will obtain the appropriate consent and will allow
you to withdraw consent in accordance with this Privacy Policy.
Information Collection
When you visit our Website or utilise our services, we may collect various types of
personal data reasonably required to facilitate matching, service delivery,
administration, communication, payment, and related operations. This may include,
but is not limited to:
● Identity & Demographic Data: Name, gender, race, and date of birth.
● Contact Data: Email address, phone number, and residential address.
● Professional Data (Service Professionals): Occupation, professional interests,
qualifications, experience, and digital copies of certifications, licences, or
other relevant professional documents.
● Service & Transactional Data: Service requirements, payment information
(including bank receipts/screenshots), session dates, attendance records,
lesson feedback, lesson plans, service updates, and other records relating to
an Assignment.
● Technical Data: IP address, browser type, device information, pages visited,
and other technical information collected when you use the Website.
If you provide personal data relating to another individual, such as a family member,
child, parent, guardian, or other person, you are responsible for ensuring that you
are authorised to provide that information to us and, where required by law, that the
necessary consent has been obtained.
In compliance with applicable PDPA requirements, Special Minds does not collect
NRIC numbers unless permitted or required under applicable law.
Use of Personal Data
Special Minds may collect, use, and process personal data for purposes including:
● Creating and managing User and Service Professional accounts;
● Assessing and matching Clients with suitable Service Professionals;
● Facilitating Assignments and service delivery;
● Communicating with Clients, parents/guardians, and Service Professionals;
● Coordinating lesson dates, times, locations, and other logistical
arrangements;
● Processing payments, invoices, refunds, commissions, and administrative
fees;
● Maintaining lesson, attendance, feedback, and service records;
● Responding to enquiries, complaints, disputes, and requests;
● Preventing, detecting, and investigating fraud, misuse, unauthorised activity,
or breaches of our Terms and Conditions;
● Enforcing our contractual rights and obligations;
● Maintaining business, accounting, tax, and administrative records;
● Complying with applicable laws, regulations, legal processes, or requests
from competent authorities; and
● Other purposes reasonably necessary to operate and administer the Service.
● Information Sharing and Disclosure
We may disclose personal data to Clients, parents or guardians, Service
Professionals, third-party service providers, and other parties where reasonably
necessary to facilitate, administer, and provide the Service, including service
matching, scheduling, communication, payment, verification, record-keeping, and
related administrative purposes, subject to applicable law.
Service Matching
Once an Assignment has been confirmed, Special Minds may share necessary
Client information with the relevant Service Professional to facilitate the Assignment.
This may include the Client's name, contact number, service address, relevant
service requirements, scheduling information, and other information reasonably
necessary for the Service Professional to provide the agreed services.
Where reasonably necessary, Special Minds may also provide relevant information
about the Service Professional to the Client, including the Service Professional's
name, professional background, qualifications, certifications, experience, and other
information relevant to the requested service.
In accordance with our Terms and Conditions, Special Minds may provide contact
details to the Client and Service Professional at least 24 hours before a scheduled
session where reasonably necessary to facilitate communication and logistics.
Communication prior to assignment confirmation may be conducted through Special
Minds, including by conference call or other communication channels, where
appropriate.
To reduce the risk of unauthorised distribution of personal documents, Clients may
request to view relevant physical or digital copies of a Service Professional's
certifications during the first session, subject to applicable privacy and professional
requirements.
Direct or Private Engagement Between Client and Service Professional
Where a Client and Service Professional independently communicate, exchange
information, or enter into a private arrangement outside Special Minds, Special
Minds may no longer control the personal data that the parties choose to exchange
directly with each other.
Special Minds is not responsible for personal data that a Client or Service
Professional voluntarily provides directly to the other party outside the Special Minds
Service, or for how that information is subsequently used by the receiving party,
except to the extent that Special Minds remains responsible under applicable law.
Clients and Service Professionals are responsible for exercising appropriate care
when sharing personal data directly with each other and should only share
information reasonably necessary for their private arrangement.
A private arrangement between a Client and Service Professional does not alter any
rights or obligations that may be owed to Special Minds under the Terms and
Conditions.
Third-Party Service Providers
We may disclose personal data to trusted third-party service providers where
reasonably necessary to operate the Service. These may include payment
processors, technology providers, website or system administrators, communication
providers, accounting or administrative service providers, professional advisers, and
other contractors engaged by Special Minds.
Such parties may only receive information reasonably necessary for the relevant
purpose and will be required to handle personal data in accordance with applicable
confidentiality and data protection requirements.
Special Minds does not sell, trade, or rent personal data.
We may also disclose personal data where required or permitted by law, including
where reasonably necessary to comply with legal obligations, respond to lawful
requests, protect our rights or property, investigate suspected unlawful activity, or
establish, exercise, or defend legal claims.
Overseas Transfer of Personal Data
Where personal data is transferred outside Singapore, Special Minds will take
reasonable steps to ensure that the transferred personal data is protected to a
standard comparable to that required under applicable Singapore data protection
laws.
Data Retention and Deletion
Special Minds retains personal data only for as long as reasonably necessary to fulfil
the purposes for which it was collected or used, or where retention is required or
permitted by applicable law.
Upon deletion of an account, Special Minds may remove or anonymise associated
profile data, notes, and other information where appropriate.
However, certain information may need to be retained for a longer period where
reasonably necessary for:
● payment, accounting, tax, or financial record-keeping;
● resolving complaints, disputes, or investigations;
● enforcing our Terms and Conditions;
● preventing fraud, abuse, or unauthorised activity;
● establishing, exercising, or defending legal claims; or
● complying with legal or regulatory obligations.
